Terms of Service

These terms (“Terms”) govern your use of the Tape macOS app and the services hosted at usetape.app (collectively, the “Service”). By using the Service you agree to these Terms.

The Service

Tape is a tool that records and transcribes conversations on your Mac. The audio and transcripts are stored locally on your device. Optionally, you may connect a Google Calendar account so the app can show upcoming events; see our Privacy Policy for what data this involves.

Your account

Acceptable use

You agree to use Tape only for purposes that are lawful in your jurisdiction. In particular, you are solely responsible for complying with any laws about recording conversations — including, where applicable, obtaining consent from other participants before recording.

You retain all rights to recordings, transcripts, and notes you create with Tape. Because these are stored locally on your device by default, we do not access them.

Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if we reasonably believe you have violated these Terms, posed a security or legal risk, or otherwise misused the Service. We will use reasonable efforts to notify you of material terminations when feasible.

You may stop using the Service at any time by deleting your account in the app or uninstalling the app.

No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. Features may change, be added, or be removed; where a change would affect data you have stored locally, we will notify you in the app before it takes effect.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless Tape from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or consent-to-record law; or (d) any content you record using the Service. This obligation will survive termination of these Terms or your use of the Service.

Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the Tel Aviv District, Israel.

Before initiating any legal action, you agree to first attempt to resolve any dispute informally by contacting or@usetape.app and allowing thirty (30) days to reach a resolution.

To the extent permitted by law, you and Tape agree to waive any right to participate in a class action, collective action, or representative action against the other.

General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tape regarding the Service. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.

Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the date at the top and, where appropriate, notify users in the app.
